Building Quality Assurance Act (Wkb)
On Jan. 1, 2024, the Building Quality Assurance Act (Wkb) will take effect. From then on, the assessment of the building requirements of a structure by the municipality will be transferred to a certified and approved quality controller, known as a quality assurance agency. The Wkb does not apply to all structures immediately on January 1, 2024.
Consequence class 1
The Wkb only applies from January 1, 2024 to structures falling under consequence class 1. Structures that fall under consequence class 1 are structures with a low risk profile such as single-family homes and simple business premises. Also, the Wkb will only apply to new construction in 2024.
Consequence class 2 and 3
For applications under consequence class 2 and 3, the municipality will still carry out the building technology test itself. Consequence class 2 and 3 are the heavier building plans, such as an apartment complex or large factory hall. The quality assurance officer ensures that a building complies with the rules when it is reported ready. This concerns technical building activities that require notification. Without a quality assurance officer you cannot submit a building notification. You may also not start building or renovating.
Opinion
We recommend approaching a quality assurance contractor ahead of time. The moment you engage a designer/draughtsman, it is also wise to already approach a quality assurance officer. The quality assurance professional can then indicate at what point he/she wants to be involved in the process. This may make the design and construction process more efficient and faster. There may be a waiting period due to the demand and supply of quality assurance professionals.

When building under Quality Assurance Act, you must pay attention to local conditions or risks. The quality assurance company takes this into account as a starting point for the risk assessment and the assurance plan.
