Before you build or renovate

Read the permit and regulations carefully

Take the time to review the permit and any regulations. Sometimes you may need to take care of things before construction begins, such as having structural calculations approved by us or a soil test. 

Objection and appeal after publication of granted permit

Within six weeks from the day after publication of the granted permit, an objection can be made. You may begin work after receiving the permit. You do so at your own risk. If someone objects, in extreme cases the permit may have to be refused. You would then have to reverse everything. We advise you to wait for the objection period.

You may not start some irreversible activities until after the objection period has expired. Consider, for example, cutting down trees and demolition.

New construction? Remember building limits

Are you going to put up a completely new structure? We want to make sure the structure will be in the right place. Therefore, the building lines and levels are plotted by order of the municipality. Please contact the building inspector no later than 5 working days in advance by calling the general number 040 - 263 16 31.

Reuse/application of soil

If excavation work (for example, when preparing for construction or digging a basement) releases soil that cannot be reused on site, it must be disposed of according to the Soil Quality Decree.

The application of soil must also comply with the rules of the Soil Quality Decree. The application of more than 50 m3 of soil must be reported to the soil quality reporting point.

Complying with laws and regulations

The permit is leading. This means that you may build as stated in the permit, unless it violates laws and regulations. Laws and regulations also contain all kinds of rules with which you must comply. These include the Housing Act, the Environmental Law (General Provisions) Act (Wabo) and the Building Decree. These rules have been established to ensure safety, health and common interests. If the environmental permit states something different from the Building Code, the Building Code must be complied with. Of course, you must comply with the Neighbor Law from the Civil Code. We are not a party to neighbor law but advise you to comply with it.

Need other permit(s)? Arrange it on time

You may need a permit not only for building or renovating. Consider, for example, cutting down a tree, constructing an entrance or connecting to the sewer system. This may also require permission from the municipality. Any driveway (if it is on municipal land) will be constructed by the municipality at your expense. Keep this in mind in your (financial) planning.

For businesses, for example, a notification or permit may additionally be required for fire-safe use or serving alcohol. At www.aimonline.nl you can find out whether you need to submit a notification or require a permit for environmental impacts.

The Nature Protection Act ensures the survival of various plant and animal species. Activities harmful to nature may require government permission. Investigate promptly whether protected species are present and apply for permission.

Move public lighting?

To relocate public lighting, please contact the municipality.

Installing gas, water and electricity?

You need prior permission from the utility company to construct installations for gas, water and electricity.

Demolish?

You always need an environmental permit if you are going to demolish within a protected town or villagescape. If the amount of demolition waste exceeds 10 m3 or if you are going to remove asbestos, you must submit a demolition notification. You must report the demolition work at least 4 weeks prior to the work. You do the demolition notification through the environment counter.

Report the start of work to the municipality in a timely manner

We ask that you inform us in writing no later than two working days before you begin the work. This also applies to excavation. You can do this by sending the card attached to the permit or by sending an e-mail to gemeentehuis@nuenen.nl with the case number of the permit.

Inform neighbors/residents

We advise you to coordinate your plans with local residents. A good relationship with your neighbors contributes to your enjoyment of life.

During construction

Health that all records are in place at the construction site

It is important to have the permit and any other important data (such as structural drawings) at the construction site.

Prevent unsafe situations and nuisances

Health for a safe construction site for yourself and those around you. Consider installing a construction fence to prevent falling materials from hitting the sidewalk or pedestrians. Try to prevent nuisance, such as noise, dust or vibration.

Checks by supervisor

The municipality's supervisor checks that everything is going well and according to the permit. As much as possible, the inspections are carried out by appointment with you. However, the supervisor may also stop by unannounced. He/she may be on the construction site without your permission. 

Report changes in a timely manner

Sometimes you may want to change your plans during construction. We ask that you communicate these changes to us first. That way we can assess whether the changes can be implemented.

Waste and construction materials storage and disposal

We ask you to store and dispose of construction and demolition waste separately on the construction site whenever possible. It is also preferable to store construction and work materials on your own site. If you do not have enough space on your own site, you can temporarily store things on municipal land. This does not require a permit if the items are not dangerous or a nuisance, the usability of the road is not impeded and no damage is done to municipal property. 

Need temporary road closure? Let us know

The road may have to be temporarily (partially) closed for, for example, placing a crane or large container. Please contact the municipality. Permission may be required for this.

Park as little as possible on sidewalks, green spaces, etc.

We understand that it is sometimes convenient to park nearby on the sidewalk or greenbelt, for example during loading and unloading. However, we ask that you do so as briefly as possible to avoid damage and to allow pedestrians (with wheelchairs or strollers, for example) to use the sidewalk safely. The boas may issue fines for obstructive parking.

After construction

Always report end of work

We ask that you notify us in writing no later than the first working day after the day the work is completed. Please use the card included with the permit or send an e-mail to gemeentehuis@nuenen.nl with the case number of the environmental permit. The structure may not be put into use until the end of the work has been notified.

Health that the building remains compliant at all times

After proper completion of the work, you can start using the structure or have it used. It is important that the building continues to comply with laws and regulations at all times. This applies to both the condition of the building and its use, as well as the effects on the living environment.

In conclusion

Are you not using the permit?

Inform the municipality if you do not use the permit. Unused permits can lead to unwanted surprises later. We will then revoke your permit.
