Participation under the Omgevingswet

The municipality of Nuenen wants residents to feel involved in what happens in their municipality. The new Omgevingswet encourages participation. Participation means that initiators - these can be residents, entrepreneurs, organizations and also the municipality itself - enter into a dialogue with their surroundings about their plan. They are responsible for this. This means that an initiator informs the environment itself and/or asks for input on the plan.

Not everyone has to ultimately agree with your plan, but if people feel heard, it does reduce the likelihood that they will object at a later stage. Better plans often come out of it, too. Involving the environment in the creation of a plan may cost you extra time at the front end, but it usually saves time over the entire process. Moreover, it is simply a matter of common decency to talk to your surroundings about what you want to do.

Guide to participation

The municipality has created a guide to participation. In it you will find all kinds of points that are important to think about. The guide is not meant to be a compulsory step-by-step plan for participation. You can use the guide as you see fit.

Mandatory participation

In a number of cases, it is mandatory to apply participation before submitting an application for an environmental permit. On Nov. 16, 2023, the City Council adopted the list of cases for which participation is mandatory:

  • Building more than 5 dwellings;

  • realizing windmills and pastures with solar panels;

  • If the activity conflicts with the Nuenen Environmental Vision;

  • If the activity conflicts with the Nuenen Structural Vision;

  • If the activity conflicts with the Nuenen-Zuid structural vision;

  • If the activity conflicts with the Gerwen Structural Vision;

  • If the activity conflicts with the Nederwetten structural vision;

  • If the activity conflicts with the structural vision Rijk van Dommel en Aa;

  • If the activity conflicts with the Landscape Vision Buitengebied Nuenen;

  • if the activity conflicts with Amendment 22 Initiative Proposal Frameworks for Higher Building Nuenen c.a. of February 17, 2022;

  • if the activity conflicts with the memorandum Bouwen in het buitengebied van Nuenen, Richtlijn voor Ruimte voor Ruimte-initiatieven in bebouwingsconcentraties;

  • If the activity conflicts with the Housing Program.
