National Ombudsman report on complaint handling

The National Ombudsman has investigated a resident's complaint about the municipality of Nuenen. The complaint concerns access to the complaints committee and the report of the complaint interview. The college was given the opportunity to respond to the report of findings by the National Ombudsman on October 29, 2024. On November 12, 2024, the college responded to the report of findings. On December 9, 2024, the National Ombudsman issued a report, which included an opinion on the complaint.

The college has taken note of the report "An investigation into complaint handling by the municipality of Nuenen.

Draft Noise Action Plan 2024 - 2029 4th installment

Making noise maps and drawing up an action plan are obligations for Nuenen arising from the EU Environmental Noise Directive. The aim of the Environmental Noise Directive is to Map and where possible improve the noise climate. The action plan includes the evaluation of the measures from the previous action plan (from 2018) and addresses the implementation of noise reduction measures and/or research into them.

The college decided to adopt the draft Noise Action Plan Parts A and B 2024-2029, 4th installment and submit it for public comment for 6 weeks.

The college agreed to send the council information letter "Noise Action Plan 2024-2029" to the city council.

Decision on objection to environmental permit Gonnekes Erf 1 to 29 and 't Zand 59 to 71

A notice of objection has been filed against the environmental permit granted for the construction of two residential buildings Gonnekes Erf 1 to 29 and 't Zand 59 to 71. The objection was dealt with at a hearing of the objections committee. The committee recommended that the decision be upheld, but that the stipulation in the environmental permit regarding the parking balance and the addition of the layout drawing be supplemented.

The college adopts the advice of the objection committee and upholds the decision of July 4, 2024, with the addition of the requirement in the environmental permit regarding the parking balance and the addition of the furnishing drawing.

Feasibility study housing development Gerwen and Nederwetten

More housing should be built for both starters in the housing market and seniors. Given various issues surrounding livability, this also applies in particular to Gerwen and Nederwetten. A feasibility study has therefore been carried out and a development strategy created for adding housing in both cores. With the study and strategy we then developed a plan of action for the coming years to facilitate housing projects. Part of the strategy includes entering into a strategic partnership with development company Ruimte voor Ruimte (RvR).

The college decided to approve the feasibility study on housing construction Gerwen and Nederwetten and the memorandum "development strategy acceleration housing construction Gerwen and Nederwetten".

The council proposal 'Feasibility study housing construction Gerwen and Nederwetten & strategic cooperation with development company Ruimte-voor-Ruimte (RvR)' is submitted to the council for decision.

Adjust agreements with school board Eenbes for use of school rooms

The previously concluded agreements with school board Eenbes for the use of classrooms in two elementary school need to be adjusted due to changing the calculation of the maintenance contribution. The number of classrooms used by Badgerburg Elementary School will also be adjusted.

The college decided to adopt and sign the amendments to the
occupancy agreements.

Out-of-plan environmental planning activity calamity path Bloemhoeve-Esrand

For some time, the municipality has wanted to construct an emergency path for the benefit of the Esrand neighborhood in Nederwetten. This path will be constructed on the Bloemhoeve street. For this purpose, an Out-of-plan environmental planning activity (Bopa) has been drawn up. This plan makes the construction of the calamity path planologically possible, as well as the planning securing of two houses on the plot of Bloemhoeve 22.

The college decided to adopt and publish the out-of-plan environmental planning activity for calamity path Bloemhoeve-Esrand.

Collaboration agreement Arts Quarter

The current agreement with Stichting Kunstkwartier and municipalities of Nuenen, Geldrop-Mierlo and Helmond regulates the distribution of financial burdens and obligations. The arrangement has shortcomings such as lack of consultation moments and ambiguities about cost sharing. Advice is to terminate the agreement, but to maintain a subsidy relationship with Kunstkwartier.

The college has decided not to enter into a new management agreement with the municipalities of Geldrop-Mierlo and Helmond as of January 1, 2025, and has decided to maintain the subsidy relationship with Kunstkwartier. One of the obligations for providing the subsidy is to introduce an annual consultation.

Decision on objection rejection of stairlift Wmo.

A notice of appeal was received against the September 12, 2024 decision on the denial of an application for a stairlift under the Social Support Act.

The College decided, in accordance with the advice of the Objections Committee, to declare the objection unfounded and uphold the decision of September 12, 2024. Objector will be informed by letter.
