Expand noise standards at hospitality industry

What is it? 

If you expect to cause so much noise within your catering establishment that you cannot comply with the regulations of the Activities Decree, you can submit a report to the municipality to arrange an extension of the noise standards. We call this reporting an incidental festivity. This notification may perhaps be necessary, for example, when performing live music or a party on the outside premises. The municipal APV (article 4.3) contains the rules and Requirements that must be met. 

How does it work? 

If you make the notification and it is approved, the municipality may give you rules. You must abide by these rules. For example, consider certain times when you may claim the expanded noise standards and the amount of the expansion. This is because this is not unlimited.

What to do? 

You submit the notification to the municipality. Please provide the following information with your report:

  • What you are going to do that may cause noise pollution
  • date and time when you may cause noise pollution
  • situational drawing if the festivity will take place on the outside premises
  • if necessary an acoustic report

Consider local residents 

To minimize any inconvenience to nearby residents, do at least the following:

  • Inform local residents at least 1 week in advance and indicate when and why noise standards have been expanded; 
  • limit the moments of possible inconvenience as much as possible; 
  • if there is another way that creates less noise impact on the environment, do it that way.

How long does it take? 

You will be notified within 4 weeks whether you may claim the expanded noise standards. The municipality may extend this deadline by 2 weeks. 

Objecting

If you do not agree with the municipality's decision, unfortunately you cannot object since this is a notification procedure. This is not subject to objection and/or appeal.
