08 Appeal Against a Denied Environmental Permit

On April 20, 2026, an objection was filed against the decision of March 31, 2026, which denied the environmental permit for the construction of a multifunctional hospitality space and an access road. On August 31, 2026, the Appeals Committee recommended that the objection be declared well-founded, that the decision be revoked, and that a new decision be made. It is proposed that, following a full reconsideration, the objection be declared unfounded, the decision of March 31, 2026, be upheld, and that a reasoned decision be made to deviate from the recommendation of the Appeals Committee. It is also proposed that the request for reimbursement of legal costs be denied.

The council has decided:
1. In accordance with the recommendation of the Appeals Committee, to declare the appeal admissible and well-founded.
2. To grant the environmental permit for the construction of a multifunctional hospitality space and the creation of an access road.
3. For the reasoning behind our decision, we refer to the recommendation and report of the Appeals Committee, which form an integral part of this decision.
4. To award reimbursement of legal costs pursuant to Article 7:15, paragraph 2, of the General Administrative Law Act (Awb).
