What is it?
Has your property been for sale for a while or do you have a property that is going to be demolished? Then you may be allowed to temporarily rent out your empty house, house for sale or other building. To do so, you must apply for a permit from the municipality. You can find more information at rijksoverheid.nl. Note: if you want to apply, use the e-form on this municipal page. Not the form found on the overheid.nl website.
What to do?
With a permit under the Leegstandwet a number of normal rental rules do not apply. This makes it easier to terminate the lease. If necessary, an extension of the permit can be requested.
Within eight weeks, the municipality will make a decision.
How does it work?
The following living spaces can be temporarily rented out under the Leegstandwet:1. living space in a building (homes or rooms in a vacant office, school or hospital, for example);2. living space in a home for sale that:
A. has never been occupied before (new construction home);
B. had been occupied by the owner in the 12 months before the property became vacant.
C. or in the 10 years before the property became vacant, it has been rented (in whole or in part) for only 3 years;
3. housing in a rental property that is going to be demolished or renovated. The renovation or demolition must be major and planned in the short term.
What does it cost?
The fees are €43.75
For a permit renewal, the fees are €22.10. (price level 2023)
