Decision on the appeal against the environmental permit granted for the legalization of an existing canopy
An objection has been filed against the environmental permit granted to legalize an existing canopy. The objection was heard during a hearing of the appeals committee.
The Municipal Executive, adopting the advice of the Appeals Committee, has decided to declare the submitted appeal admissible and partially well-founded, and has decided that the contested decision of October 23, 2025, shall remain in force, subject to the addition of a statement of reasons. The decision on the objection explicitly states that the permitted structure must be classified as a building and not as a canopy. The description in the decision on the objection and the operative part of the decision will be amended accordingly.
The objector and the permit holder will be notified by letter.
Additional Tasks Package for the Joint Arrangement (GR) of the "A 10 for Youth" Youth Region
For the procurement of youth services, Nuenen is part of the joint arrangement known as the “Een 10 voor de Jeugd” Youth Region. The Youth Care Availability Improvement Act requires municipalities to jointly procure certain forms of youth care. However, the “Een 10 voor de Jeugd” Youth Region performs additional tasks. It is necessary for these tasks to be assigned to the “Een 10 voor de Jeugd” Youth Region as additional responsibilities and for the mandate decision to be amended.
The municipal executive has decided to enter into the Specialized Youth Services supplementary agreement with the “Een 10 voor de Jeugd” Youth Region joint arrangement.
It has been decided to authorize Alderman to sign the supplementary agreement.
The council has decided to approve the Amendment to the Mandate Decision for the Youth Region "A 10 for Youth 2026."
Comments on the 2027 Draft Budget of the VRBZO
Under the Joint Regulation of the Brabant-Zuidoost Safety Region (VRBZO), the councils of the participating municipalities are given the opportunity to submit their views on the draft budget. The Executive Committee takes the submitted opinions into account when preparing for decision-making on the budget in the General Board.
The council proposal “Opinion on the 2027 VRBZO Draft Budget” is submitted to the council for decision-making.
Accession to the East Brabant Tax Cooperation Joint Arrangement (BSOB) effective January 1, 2028
Effective January 1, 2024, the Dommelvallei Service, acting on behalf of the municipalities of Geldrop-Mierlo, Nuenen and surrounding areas, and Son en Breugel, entered into a service agreement with the East Brabant Tax Cooperation (BSOB). Under this agreement, the implementation of WOZ and tax-related tasks has been transferred to BSOB. The agreement with BSOB will expire by operation of law on January 1, 2028. There is no option for renewal. It is proposed to join the BSOB joint arrangement as of January 1, 2028, following approval by the municipal council.
The council proposal titled "Accession to the BSOB Joint Arrangement as of January 1, 2028" is being submitted to the council for a decision.
Statement of Principles for the Rural Area Environmental Program
In accordance with the approved Action Plan for Environmental Programs (November 2023), the Statement of Principles is adopted by the municipal executive. The Statement of Principles sets out the initial ideas regarding the direction of the environmental program yet to be developed. The Statement of Principles is the result of consultations with internal and external stakeholders.
The council has decided to adopt the Statement of Principles as the starting document for the rural area environmental program and has determined that a PlanMER assessment is sufficient for the preparation of the rural area environmental program.
The council will be informed of this via a council information letter.
Request for an exemption from the anti-speculation clause
A resident is requesting an exemption from the provisions regarding owner-occupancy and restrictions on disposal (hereinafter referred to as the owner-occupancy requirement) as set forth in the deed of conveyance for the residence. The recommendation is to grant the exemption on the condition that the former partner becomes the sole owner of the home and continues to reside there, so that the purpose of the owner-occupancy requirement (preventing investment/speculation) remains intact.
The council has decided to grant an exemption from the anti-speculation clause subject to the condition stated.
Proposed sale of the north side of the Gulbergen Estate
The Eindhoven Metropolitan Region (MRE) plans to sell two parcels of land to a third party. These parcels were previously sold to the MRE by the municipality of Nuenen. At the time, the deed of ownership included a right of first refusal (right of first purchase) in favor of the municipality. MRE is asking the municipality to waive this right of first refusal.
The municipal executive has decided to inform MRE that the municipality will waive its right of first refusal, both for these plots and for any other plots, should that become relevant in the future.
