Provide Power of Attorney Deed Vesting Qualitative Obligation

In 2021, the municipality applied for a grant from the Groen Ontwikkelfonds Brabant for the ecological development of the Hooidonksche Beek on the north side of Nuenen. The subsidy was granted under the condition that the nature development is secured for the future. This can be done by including it in a notarial deed.

The college has decided to establish (or have established) a qualitative obligation in favor of Groen Ontwikkelfonds Brabant BV on the immovable property cadastral municipality of Nuenen, section E numbers 8079, 8970 and 7182.

The municipality of Nuenen was placed under active supervision by Gedeputeerde Staten in 2023 because the statutory process criteria for licensing, supervision and enforcement (VTH) were partially not met. The partial non-compliance is not about licensing and/or enforcement decisions or their quality, but about the timeliness and timeliness of the VTH report, VTH implementation program and VTH policy. Agreements were made with the province's Interadministrative Supervisor on July 25, 2023 regarding the follow-up process. It was agreed that the current VTH policy will be extended until July 1, 2024 and new VTH policies will be drafted in the meantime. In addition, it was agreed that by November 1, 2023, we will still adopt a report for 2021 and 2022 of the VTH tasks performed and a VTH implementation program for 2023.

The college decided to extend the Environmental Law Enforcement Policy 2017-2021 and the Environmental Law Permit Policy 2020-2021 until July 1, 2024.
The College agreed to adopt and announce the VTH Report 2021-2022 and the VTH Implementation Program 2023 as one combined document to the City Council and forward to the Inter-Governmental Supervisor of the Province for notification. The Council Information Letter on this matter will be adopted and forwarded to the Council.
