Public decision list Sept. 2, 2024

Temporary location weekly market

Beginning in the third quarter of 2024, The Monastery will be remodeled for a period of 1.5 to 2 years. Currently, the weekly market is located on the thoroughfare in front of Het Klooster. To ensure access to The Monastery during the renovation, the weekly market must be relocated.

The college has decided to designate the kiosk in the Park as a temporary location for the weekly market during the renovation of The Monastery. A letter will be sent to the Weekly Market Foundation confirming the temporary situation and indicating that a reassessment of the market c.a. has taken place even before the completion of The Convent. A brief council information letter on this will also be sent to the council.

Residential Care Vision

The 'Vision on Living, Welfare and Health' (hereafter: the residential care vision) forms the starting point for the approach to the residential care tasks in the municipality of Nuenen. We outline what is needed to properly house people with special housing needs in the future and what goals we want to set for this in the areas of housing, society, welfare and Health.

The council has agreed to the 'Vision on housing, welfare and Health' (woonzorgvisie). The council proposal will be presented to the council for decision.

New decision on objection to enforcement request to keep horses Soeterbeekseweg 13

In response to an enforcement request regarding the keeping of horses on the property at Soeterbeekseweg 13 in Nuenen, a negative decision on the enforcement request was made on March 28, 2022. An objection to this was filed. On October 24, 2022, the committee advised that the objection was admissible and well-founded; the committee believed that transitional law was not applicable. Following the committee's advice, in March 2023 the college rescinded the contested decision of March 28, 2022 and instead ordered the owners of the Soeterbeekseweg 13 parcel to cease and desist from the business of keeping horses on the parcel by May 5, 2023. This was appealed by the owners of the parcel. In its ruling of November 10, 2023, the court upheld the appeal and overturned the contested decision. The court held that the transitional law did apply and for that reason the college was not authorized to act with a penalty payment. The court ruled that a new decision must be made in compliance with the ruling.

The college decided to make a new decision on the objection of May 6, 2022 in compliance with the court's ruling of November 10, 2023 to: declare the objection admissible and unfounded and uphold the contested decision of March 28, 2022.

Amendment of WSD joint arrangement

The Joint Scheme (GR) WSD was amended due to the new direction of the GR WSD, the performance of tasks without a legal basis, the redivision of the municipality of Haaren as of 2021 and changes in the Wgr (Wet gemeenschappelijke regelingen). The text proposal was submitted to the municipal councils for views, with some municipal councils submitting views that led to changes. The Nuenen town council did not submit any views. The GR WSD is now asking the college, subject to council approval, to adopt the changes definitively.

The college has decided to agree to the establishment of an amended WSD joint scheme in accordance with the attached draft scheme, after obtaining the consent of the municipal council at
. The council proposal will be submitted to the council for decision-making.
