Collective exemptions noise 2024 for hospitality industry
Pursuant to article 4:2 paragraph 1 of the APV, the Municipal Executive determines collective days each year on which the noise limits of the Activities Decree Environmental Management Act do not apply to (catering) businesses.
The college decided to designate the days of carnival and the fair Nuenen village and Gerwen as collective festivities for 2024, so that extended noise standards can be used.
Grant ceiling earmarked social housing reserve
Setting a grant ceiling under the "Social Housing Grant Ordinance 2019" prevents an open-ended nature of the grant scheme.
The College decided to set the grant ceiling for the period January 1, 2024 to June 30, 2024 at a maximum of €159,500.
Environmental programs plan of action
A plan of action has been drawn up for the preparation of the environmental programs for Nuenen. This was done to provide insight into the process of creation, the efforts required and the desired content of the environment programs and to ensure the integrality and uniformity of the environment programs.
The college decided to adopt the plan of approach to environmental programs and inform the city council through a council information letter on the entry into force of the Omgevingswet.
Extension of occupational health and safety services
On January 1, 2022, the Dommelvallei organizations entered into cooperation with ArboNed health and safety service for the duration of 2 years, with the option to extend the agreement up to 2 times for 2 years. An evaluation took place in April 2022 and May 2023. The agreement ends on January 1, 2024.
The college decided to extend the agreement, with some changes in services.
Municipal forests management plan
For the municipality of Nuenen, a new updated "management plan forest and natural areas 2023-2028 municipality of Nuenen c.a." has been drawn up. We have been outsourcing the organization of management implementation to the Coöperatie Bosgroep Zuid Nederland for several years.
The college decided to adopt the "Management Plan for Forests and Natural Areas 2023-2028 Municipality of Nuenen c.a." to adopt the "Management Plan for Prudent Management and Maintenance of Municipal Forests and Natural Areas.
Furthermore, the college decided to enter into a "Management agreement forest and natural areas 2023-2028" with the Coöperatie Bosgroep Zuid Nederland for organization of the implementation "Management plan forest and natural areas 2023-2028 municipality Nuenen c.a.".
Resale of three apartments by association Woongroep de Mijlpaal to Bouwbedrijf gebr. Van Herpen b.v.
The Woongroep asks the municipality -in deviation from Article 5.9 and Article 10.1 of the realization- also sales agreement dated November 8, 2021- to agree to the resale of three apartments to Van Herpen. In addition, the Woongroep asks for a postponement of the delivery of the project area.
The college decided to grant permission to the Woongroep to resell three apartments to Van Herpen under the following Requirements :
- Those to whom Van Herpen sells the apartments in question must be members of the Woongroep;
- all obligations applicable to the Woongroep and its members with respect to the apartments will be transferred to the final buyers of the three apartments.
The college authorizes the Woongroep to transfer the right of delivery of these three apartments to Van Herpen.
The college has agreed to postpone the delivery of the project area until January 31, 2024 at the latest, under the condition that, if this deadline is exceeded, the Woongroep will owe the legal interest on the purchase price from this date until the moment of actual delivery.
Calamity plan archives
The purpose of this contingency plan is to prevent and limit damage during an emergency situation where archives are damaged or in danger of being lost.
The college decided to adopt the archives contingency plan.
Method of budget accuracy financial statements 2023
In the 2023 financial statements, the college will include a legality statement for the first time. In order to clarify how we interpret budget legitimacy in the 2023 financial statements, agreements have been made with the auditor on this matter.
The college has decided to adopt the method of budget legitimacy for the 2023 financial statements.
The council proposal "Budget accuracy for the 2023 financial statements" is submitted to the council for decision.
Updating Rules for handling appeals
The method of handling appeals is laid down in the "Regulations on Advising Appeals 2018. The Regulations are in need of updating.
The council decided to adopt the new "Regulation for the handling of notices of objection Nuenen 2024" and to withdraw the current regulation.
The council proposal " Actualization Regulation for the handling of notices of objection" is submitted to the council for decision.
Objection decisions on three temporary use environmental permits for dog walking services
Three different environmental permits have been issued for three locations within the Stiphout Woods to change the use for a dog walking service for a period of 10 years. They are Rullen ong. B3295 and B3296/ Sniffing Snout, Rullen ong. B2367/ Cookie & Co, Mikboomweg ong. B5154, B1848, B1939. However, in its June 30, 2023 ruling, the court overturned the environmental permits and ordered the college to make a new decision on the objection, taking into account the ruling.
The College decided to declare the objections directed against the environmental permit granted to the Sniffing Snout admissible and unfounded. The contested environmental permit is supplemented with the aforementioned Requirements and upheld with the addition of the recitals.
The objection directed against the granted environmental permit with reference N-HZ-2020-0175 is declared admissible and well-founded. The contested environmental permit is revoked and refused.
The objection directed against the environmental permit granted to Cookie & Co is declared admissible and well-founded. The contested environmental permit is revoked and refused.
Service Agreement East Brabant Tax Cooperation.
Tax and collection tasks are outsourced to the East Brabant Tax Cooperation (BSOB). A service agreement is entered into for this purpose.
The college agreed to outsource the tasks in the field of taxes and collection to the Belastingsamenwerking Oost-Brabant, by entering into a service agreement.
A mandate is granted to the Director of the Dommelvallei Service to enter into the service agreement and the associated processing agreement, on behalf of the Municipality of Nuenen.
The Mayor is requested to delegate the signing of the Service Agreement and the Processing Agreement to the Director of the Dommelvallei Service.
The Collegebesluit formele aspecten DVO Dienst Dommelvallei - Belastingsamenwerking Oost-Brabant 2024 is adopted.
Modification of Joint Regulation Cleaning Blink, 1st phase
The proposal deals with the future arrangement of the municipal waste collector 'Blink'. The council is proposed not to submit an opinion regarding the draft joint arrangement cleaning Blink.
It is proposed to the City Council, at its meeting of February 7, 2024, not to express an opinion, as referred to in Article 1, third paragraph, of the Joint Arrangements Act, regarding the draft Joint Arrangement Cleaning Blink, as it will read after the deregistration of PreZero.
The council proposal: Amendment Joint Arrangement Cleaning Blink 1st phase" is submitted to the council for decision-making.
