08 Opinion on the Proposed Amendment to the Blink Joint Arrangement

The Blink Joint Arrangement carries out waste collection and street cleaning services for nine municipalities. The municipality of Nuenen is a participant in this arrangement. The reason for amending the arrangement is a combination of legal and strategic developments. A legal review revealed that the participation of the private party PreZero within the joint arrangement was not tenable from a public procurement law perspective. PreZero subsequently decided to withdraw from the partnership. This led to a two-phase revision of the arrangement.

In the first phase, PreZero withdrew from the program, and the program was amended from a legal and technical standpoint to ensure it complies with applicable laws and regulations. This amendment took effect on January 1, 2025.

The second phase involves policy adjustments, including those related to Blink’s tasks and authorities, the relationship between municipalities and Blink, and the Requirements for joining and leaving the organization. During this phase, municipal councils will have the opportunity to submit their opinions on the draft regulation. Once the consultation process is complete, a decision will be made regarding the final amendment.

The college decided:

  1. To approve the City Council’s draft opinion regarding the proposed amendment to the Blink Joint Arrangement.
  2. The council proposal titled “Opinion on the Proposed Amendment to the Blink Joint Arrangement” is to be submitted to the council for a decision.

09 Authorization to Enter into Agreements Through August 31, 2026

To increase the likelihood that a housing project will receive an electricity connection (transmission capacity) through “early application” and priority, it is important that private-law agreements be entered into. Agreements must be concluded no later than August 31, 2026, in order for a project to be included in the municipal registration process for submitting applications to the grid operator starting October 1, 2026. It is possible that not all agreements—which are normally decided upon by the municipal executive—can be submitted to the municipal executive in time. Therefore, authority is granted to decide on entering into agreements, and power of attorney to sign these agreements is granted to the Spatial Development Alderman for the period from August 11 through August 31, 2026.

The college decided:

1. To grant a mandate to the Spatial Development Alderman to, through December 31

August 2026: to enter into letters of intent and/or preliminary agreements for

housing projects.

2 To request that the mayor grant power of attorney to the Spatial Development Department ( Alderman ) to sign the agreements referred to in decision item 1.

10 Opinion on the amendment to the investment budget for the new Blink building

The Blink Joint Arrangement carries out waste collection and street cleaning services for nine municipalities. The municipality of Nuenen is a participant in this arrangement. In 2025, Blink’s General Board approved an investment budget of €11.5 million for the construction of a new facility in Helmond. Since then, the construction schedule has been delayed, and construction costs, land prices, and other investment costs have risen. As a result, the total investment has increased to €15.3 million. In accordance with previously made agreements, the municipal councils will once again be given the opportunity to submit their views before the General Board makes a final decision.

The college decided:

  1. To approve the attached draft opinion of the City Council regarding the amendment to the investment budget for the new Blink building.
  2. The council proposal titled “Opinion on the Amendment to the Investment Budget for the New Blink Building” is to be submitted to the council for a decision.
