Request to review negative view of sale of property Monastery Street 15

In January 2021, at the request of Helpt Elkander, the college gave an opinion on the proposed sale of Kloosterstraat 15, which formerly housed Health . This was negative, because with it social and potential public housing real estate disappears. Helpt Elkander now requests the college to revise its opinion.

The college decided to maintain the previous view and inform Helpt Elkander and the intended buyer by letter.

Agreement Framework SGE Housing 2022

In the Agreements Framework for Housing 2022, the 9 municipalities in the Eindhoven Urban Area (SGE) make agreements on quantity and quality of housing construction. The Agreements Framework makes it possible to accelerate even more. It takes into account the current housing market, recent forecasts and studies and the Woondeal/MIRT ambitions. It is a building block for the Urbanization Agreement with the state and province. It gives Nuenen opportunities to accelerate and realize the envisioned housing program.

The college has decided to approve the Agreements Framework SGE Housing 2022 'Building the Future'. The council proposal "Agreements Framework SGE Housing 2022 'Building the Future'" is submitted to the council for decision.

Old Lands cemetery management

The college has decided to outsource the management of the Oude Landen municipal cemetery to a newly formed foundation board (aim for January 1, 2022). The new board to be formed for the foundation management municipal cemetery Oude Landen consists of persons working outside the municipal organization of Nuenen. A council proposal for an upgrade of the Oude Landen municipal cemetery will be developed in cooperation with the newly formed foundation board.

Draft zoning plan "Buitengebied, revision Soeterbeekseweg, Blekerdijk intersection, Ruimte voor Ruimte"

The preliminary draft zoning plan "Buitengebied herziening Soeterbeekseweg, intersection Blekerdijk, Ruimte voor Ruimte" was available for public inspection for six weeks from April 3, 2021. Two public comments were submitted. The treatment of the reactions are reflected in the memo of public participation and preliminary consultation. The zoning plan can now be submitted for public inspection as a draft zoning plan, simultaneously with the draft decision "higher value" under the Noise Abatement Act.

The college decided to adopt the Notice of public participation and preliminary consultation of the preliminary draft zoning plan "Buitengebied herziening Soeterbeekseweg, intersection Blekerdijk Ruimte voor Ruimte" and to approve the draft zoning plan "Buitengebied herziening Soeterbeekseweg, intersection Blekerdijk Ruimte voor Ruimte".

The college adopts the draft decision "higher value" under the Noise Abatement Act for the two space for space homes within the zoning plan "Buitengebied herziening Soeterbeekseweg, intersection Blekerdijk Ruimte voor Ruimte". The draft zoning plan and the draft decision "higher value" will be made available for inspection for six weeks.

Decision on objection urgency social rental housing

The regional urgency scheme, to accelerate eligibility for social housing, is meant to be a safety net. According to the regional Urgency Committee, which evaluates urgency requests, the applicant does not meet the criteria. She objected to this.

The College decided to declare the objection -in accordance with the advice of the Objections Committee- admissible and unfounded. The decision on the objection will be sent to the objector.

Grant 2021 - NGN200

In 2021 the municipality of Nuenen, Gerwen and Nederwetten will exist 200 years. An amount of
€ 50,000.00 has been made available. The NGN200 Foundation, which has been established, has submitted a grant application for various activities.

The college decided to grant an amount of up to € 50,000.00 to the NGN200 foundation for the purpose of organizing activities that contribute to the celebration of the 200th anniversary of Nuenen, Gerwen and Nederwetten.

Answering written questions regarding ruling Council of State zoning plan "Nuenen-Centrum area development De Vank"

The College has received written questions pursuant to Rule 46 of the Rules of Procedure (Rvo) from the W70 Group. The questions are about the area development De Vank, specifically the development of the Van Lenthof (former scouting location Panta Rhei) and the recently (partly) annulled zoning plan 'Nuenen-Centrum area development De Vank' by the Council of State. The group asks the position of the college on the continuation of the process.

The College decided to answer the written questions under Rule 46 of the Rules of Procedure (Rvo) by letter.

Regional Bibob Policy 2021

The municipalities of Nuenen c.a., Son en Breugel, Geldrop-Mierlo, Valkenswaard, Cranendonck and Heeze-Leende are working together to make themselves more resilient against undermining crime. The six Dommelstroom municipalities have now adopted new policies for the application of the Wet bevordering integriteitsbeoordelingen door het openbaar bestuur (the Bibob Act). Having the same policy is important, among other things, for preventing the so-called 'waterbed effect'. For Nuenen, this concretely means that all possible policy areas will be actively tested. Previously, active testing was only carried out for liquor and catering licenses and operating licenses.

The college decided to adopt the policy rule Wet bibob gemeente Nuenen c.a. 2021 and to withdraw the Policy rule bibob 2019 gemeente Nuenen c.a.

Framework land prices and operating contributions 2022

The 2019-2023 Land Policy Memorandum states that land prices and operating contributions are set annually. This is done by adopting the Land Prices and Operating Contributions Framework document. The updated framework includes the land prices and operating contributions for 2022.

The council proposal "Framework Land Prices and Operating Contributions 2022" is presented to the council for decision.

Decision on objection

Objection to decision dated April 23, 2021, disregarding application for Social assistance benefit dated February 24, 2021, pursuant to the Participation Act.

The college decided to declare the objection to the contested decision admissible and to declare the objection -in accordance with the committee's opinion- unfounded and to uphold the contested decision of April 23, 2021. The request for reimbursement of legal costs is denied.

Wederikdreef zoning plan

The draft zoning plan 'Wederikdreef te Nuenen' has been available for public inspection for six weeks. Three written views were submitted. The views have led to partial adjustments of the draft zoning plan. The adjustments are not such that the plan must be made available for inspection again. The zoning plan including the note of views can therefore now be adopted by the council.

The council proposal "zoning plan Wederikdreef te Nuenen" is submitted to the council for decision.

Drafting municipal heritage policy

The archaeological policy map was adopted in 2009. This Map is used when drafting zoning plans and issuing environmental permits. The province's Cultural Heritage Map is used to determine the cultural-historical value. Many municipalities within the Eindhoven Metropolitan Region have now switched to a digitally accessible heritage map.

The council proposal "Drafting Municipal Heritage Policy" is presented to the council for decision.

Audit 2021

Before the auditor starts the audit of the 2021 financial statements, it is necessary to adopt the 2021 audit protocol including standards framework.

Management letter 2021 municipality of Nuenen

The auditor issued the management letter following the interim audit in recent weeks. The auditor's recommendations are accompanied by a Management Commentary.
The college accepts the Management letter for notification and adopts the Management commentary. Both will be presented to the audit committee.

September Circular Municipal Fund 2021

On November 11, 2021, the council adopted the Program Budget 2022 and multi-year estimate 2023-2025. The budget was based on the May Circular 2021. At the time of publication of the budget, October 1, the September Circular was only just known and had not yet been calculated. A separate council proposal is now being submitted to still incorporate the effects of the September Circular 2021 into the 2021 budget as well as the 2022-2025 budget.

The college decides to submit the council proposal "September Circular Municipal Fund 2021" to the council for decision.

Periodic penalty decision following notice of default

Due to the failure to make a timely decision on the objection, the municipality has been placed in default by the objector. It concerns an objection to the denial of reimbursement for diagnostics under the Youth Act. A decision must be made on this notice of default.

The College decided to issue a decision on the notice of default and to award the maximum penalty of €1,442.00.
