Bibob investigation
The municipality of Nuenen is committed to a pleasant and safe living and working environment. We therefore consider it important - when cooperating with requests or applications - that we are dealing with parties of integrity. We use the possibilities offered by the Bibob Act (Bevordering Integriteitsbeoordelingen door het Openbaar Bestuur) to prevent us from unintentionally facilitating criminal activities. We want to protect our own integrity. We also want to protect the competitive position of honest, reliable entrepreneurs. A Bibob investigation can be conducted at the time of an application and during negotiations or an award procedure, but can also be conducted at a later time, for example, when the permit or subsidy has already been granted or an agreement has been concluded.
When to conduct a Bibob investigation?
The municipality may conduct a Bibob investigation of:
- decisions, these include permits such as those under the Alcohol Act, operating licenses and environmental permits;
- grants under the General Grant Regulation;
- government contracts;
- real estate transactions.
What does a Bibob investigation entail?
A Bibob investigation begins with your own investigation by the municipality. You will receive a Bibob questionnaire from the municipality for this purpose. Complete this form in full, sign it and return it - together with the requested information - to the municipality. The municipality examines the completed Bibob questionnaire, the enclosed attachments and open sources such as the Trade Register or the Land Register. Among other things, we want to gain insight into who all are involved. We also want to get a complete picture of the circumstances under which the activities take place and the control over them. In some cases, additional information is requested.
It is important to provide all requested information!
Do you not provide the requested information? Then you will first be given the opportunity to provide that information. If you refuse to do so, your application may be rejected or negotiations may be broken off.
National Bibob Bureau
Does the municipality still have doubts after its own investigation? Then the National Bibob Office may be asked to issue an opinion. The municipality will inform you of this by letter. You cannot lodge an objection or appeal against the intervention of the Landelijk Bureau Bibob. However, you can withdraw your permit application or break off negotiations.
The National Bibob Bureau falls under the Ministry of Justice. Additional data may be requested by the Landelijk Bureau Bibob. The Landelijk Bureau Bibob advises the municipality on the degree of danger of abuse of permits, subsidies, tenders and real estate transactions. The procedure to arrive at a decision or agreement becomes longer at the moment that Landelijk Bureau Bibob is going to investigate and an advice is awaited from the bureau.
Outcome of Bibob investigation
If nothing emerges from the investigation, there is no obstacle under the Bibob Act to granting a license or entering into an agreement. If the Bibob investigation reveals that there is a danger that the municipality is facilitating criminal activities, we may refuse an application for a permit or subsidy, or refuse to award a contract. Or we may choose not to enter into a real estate transaction. We can also revoke pending permits/grants, withdraw awarded contract and dissolve a real estate transaction already entered into.
We can also refuse if a criminal offense has been committed in order to obtain the permit or grant or to achieve a government contract or real estate transaction. This includes, for example, forgery or bribery. The municipality may also refuse if there is a serious suspicion of such an offence.
